Updated July 2026 · for the 1 Jan 2027 rules

The New Starter Pack

From 1 January 2027 an employee can claim unfair dismissal after six months, not two years, and the compensation cap disappears on the same day. Anyone you hire now reaches that six-month mark after the new rules are live. This pack covers how to hire properly, and gives you the forms to do it.

  • Your last safe decision date: the date by which a hire has to be confirmed or concluded, worked out from the start date and the notice period
  • The day-one written statement the law says every new starter must have, as a fill-in form
  • Employee privacy notice, ready to complete, which UK GDPR requires and most small employers miss
  • Right to work check record: helps you record and retain your evidence (the statutory excuse depends on doing the prescribed check correctly)
  • Key dates planner, new starter details form and probation review sheets
  • Three probation outcome letters: confirm, extend, or end it properly
  • A six-month management timeline, and the 2026/27 numbers you need to budget a hire

From 1 January 2027 the cap on unfair dismissal compensation is abolished, so awards are assessed on the employee's actual loss. This is £4.99, and it is an allowable business expense.

What's inside

What's in the pack

Your last safe decision date
Continuous service keeps running through notice, so the date you must decide by is the six-month point minus the notice period. Worked examples, plus a planner to do it for your own hire.
Written statement of particulars
The document section 1 of the Employment Rights Act 1996 requires on or before day one. Every statutory particular, as a form you fill in and hand over.
Employee privacy notice
A two-page UK GDPR notice ready to complete, covering lawful basis, sharing, retention and rights. The duty most small employers never realise they have.
Right to work check record
Penalties start at £45,000 per worker. This sheet helps you record and retain your evidence — but the statutory excuse depends on carrying out the prescribed right-to-work check correctly (and keeping the dated record).
Probation reviews that hold up
Review sheets built around the four elements of a fair process, plus three outcome letters: confirm, extend, or end employment properly.
The 2026/27 numbers
Minimum wage, employer NI at 15%, Employment Allowance, auto-enrolment thresholds, SSP with the waiting days removed, and statutory notice.

Different tax, same problem: a deadline with an automatic penalty attached. If you have disposed of a second property, you may have only 60 days from completion to report and pay, and the penalty starts at £100 regardless of the size of the gain.
